Expert Determination
An ADR process where an independent construction expert is appointed by the parties to decide the matter. The expert's decision is (by prior agreement of the parties) legally binding on the parties. Like all Alternative Dispute Processes, it is entirely confidential. Expert Determination is ideally suited to disputes and matters of valuation of the Works and issues that are primarily dependent on technical issues, such as the value of the account, delay claims, valuation of variations, and other construction contract performance matters.
The parties can agree on the scope of the instruction (terms of reference) and the methodology to be adopted by the expert. It is, therefore, essential that the expert understands the terms of reference and follows them.
