EXPERT DETERMINATION

Expert Determination is a dispute resolution process in which an independent expert in the subject matter of the dispute, is appointed by the parties to resolve the matter. The expert’s decision is (by prior agreement of the parties) legally binding on the parties. Like all Alternative Dispute Processes it is entirely confidential.

Expert Determination is ideally suited to disputes and matters of valuation of the Works and/or issues which are primarily dependent on technical issues, for example, value of account, delay claims, valuation of variations and other construction contract performance matters.

As a process, the parties are free to agree the scope of the instruction and even the method to be adopted by the independent expert. It is therefore incumbent that the Independent Expert understands the terms of reference and follows it.
